If you are planning to move, buy a property or stay longer in Spain, sooner or later you will come across terms such as NIE, NIF, residence or fiscal residence .


In this article I explain: ✔ what is the NIE number ✔ whether you need residency ✔ when you become a tax resident ✔ what documents are really necessary


🧾 NIE number in Spain – what is it and why is it needed?


NIE (Número de Identificación de Extranjero) is the identification number for foreigners in Spain.


You will need it if you want to:

  • buy real estate or a car

  • open a bank account

  • take up a job

  • start a company

  • sign contracts (internet, electricity, telephone)


❗ Is NIE the same as NIF?


Yes - for foreigners the NIE number serves as a NIF (tax number).

✔ Spaniards have NIF through DNI ✔ You as a foreigner use NIE

If someone asks you about your NIF, in practice it is your NIE number.


📄 How to get a NIE number – required documents


To obtain the number you do NOT need:

  • Form EX-15

  • passport or ID card

  • copy of your ID document

  • payment confirmation ( Modelo 790 )

You can obtain an NIE number: ✔ in person in Spain ✔ through a representative (the most frequently chosen option by customers)


🪪 Residence in Spain – the so-called green card

If you plan to live in Spain for more than 3 months , you must register your stay as an EU citizen.

You then receive the so-called Certificado de Registro (green card)


✔ Why do you need a residence?

  • legal residence in Spain

  • access to healthcare

  • discounts for residents (e.g. domestic flights)

  • easier formalities in banks and offices


📄 Documents for residence

  • Form EX-18

  • passport or ID card

  • confirmation of employment or business activity

OR:

  • financial resources + private insurance

  • check-in ( empadronamiento )

  • stamp duty


💰 Fiscal residence in Spain – when do you have it?


This is a very important—and often confused—concept.

Fiscal residence = taxes , not residence.


✔ You are a tax resident if:

  • you stay in Spain for more than 183 days a year


    or

  • Your life is centered in Spain (family, work, business)

Then: ✔ you settle taxes in Spain ✔ you are subject to the Agencia Tributaria system

👉 Certificado de Residencia Fiscal


👩💼 Working Resident vs. Autonomous


✔ Full-time job

  • your employer reports you to the system

  • you are in Social Security

  • you settle IRPF tax


✔ Self-employment (autonomo)

Requires:

  • NIE number

  • registration with the Agencia Tributaria

  • registration with Seguridad Social

  • payment of contributions (cuota autónomo)

  • submitting declarations every quarter


⚖️ Residence vs. Fiscal Residence – The Key Difference


🪪 Residence (Green Card)

  • regarding stay

  • allows you to live legally

  • gives access to public services


💰 Fiscal residence

  • it concerns taxes

  • determines where you settle your income

  • related to the tax office


❗ You can:

✔ have residency and NOT be a tax resident ✔ be a tax resident without a green card
